Terms and Conditions

The following terms and conditions apply to all visits and transactions on Alcoveart.ie.  The use of the Alcove Art website indicates your acceptance of these terms and conditions.  The placement of an order indicates your acceptance of these terms and conditions.  Please read them carefully and print a copy for future reference.

General

These terms and conditions do not affect your statutory rights.  We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Accuracy of Product Information and Description of Goods

All product specifications, images and other information published on our website have been provided by Alcove Art.  The intention of Alcove Art is that all information on the website should be as accurate and up to date as possible.  However, Alcove Art cannot guarantee the reliability or the accuracy of the information contained within its pages where information may come from third parties such as suppliers and manufacturers.  All images, sizes and descriptions, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods and are not subject to a guarantee of accuracy.  Full detailed specifications are available from Alcove Art on request.

Payment and Price

The total price payable for the goods will be stipulated at the time when you place your order, whether or not the order has been confirmed.  We are entitled to make adjustments to the price to take account of any increase in our suppliers' prices, or the imposition of any taxes or duties, or if, due to an error or omission, the price published for the goods is wrong, whether or not the order has been confirmed.  We will inform you of the correct price and give you the opportunity to cancel the order.  All prices on our website are VAT-free, and do not include delivery charges.  Delivery charges will be displayed and payable as indicated at the time of placing your order.

Typographical Errors

In the event a product is listed at an incorrect price due to typographic error or an error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price, whether or not the order has been confirmed.  If payment has already been charged and we subsequently cancel your order we will immediately issue a refund to the value of the incorrect price (including delivery charges).

Payment methods

We accept all major credit and debit cards, either directly or through Paypal Commerce.  As part of the secure ordering process you must provide us with your exact billing address and telephone number as on record with your bank.  Incorrect information may cause a delay in processing your order, or even result in your bank declining payment.  Your order will only be processed once authorisation of your card has been properly received.

Availability of Goods

All products and services are subject to availability and may be withdrawn without notice.  If we are unable to supply the goods for any reason we will not charge you for these, and we will refund any money already paid for them.  However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

Delivery Charges and Delivery Times

Most orders are processed within two to three working days.  Dates are given in good faith but are not the subject of any warranty or condition.  No liability will attach to us if delivery periods or dates are not met.  Please feel free to contact us if you have any queries regarding this matter.

Time Limitation for Notification of Claims

Shortages:  Any shortages must be notified to us within seven days from delivery.

Incorrect goods:  It is your responsibility to notify us of any incorrect goods supplied within seven days from delivery.

Non-Delivery of goods:  We will not accept liability for goods lost in transit unless we are notified within ten days from the expected delivery date.

Cancellation of Orders and Returned Goods

If you are not totally satisfied with your purchase for any reason you have the right to cancel your order within 14 working days, starting from the date after the day of delivery, for credit or refund.  It is your responsibility to return purchases in pristine condition, and in original boxes and packaging.  For full details of how to return, please contact us.  You will be wholly responsible for the cost of return delivery and safe return of the goods.

Subject to claim validity and correctly notified in accordance with the Time Limitation for Notification of Claim paragraph of these terms, goods received back incomplete or in a damaged or used condition will either be returned to you and the cost of delivery charged to your account, or we reserve the right to levy a surcharge on such returned goods at a minimum 15% of the invoice price.

If you do not return goods within seven days after you have informed us that you wish to cancel your order we reserve the right to arrange collection of the item from you, and to charge you for such collection.

For cancellation of orders or amendments to orders please notify us within two hours of placing the order.  Beyond this point we may not be able to make changes or cancel if the order has been passed to our fulfilment department.

Intellectual Property and Content

The intellectual property rights of all content, including images, made available to you on or through this website, emails, marketing and our social media platforms remains the property of Alcoveart.ie licensors or owners, and are protected by copyright laws and treaties around the world.  All such rights are reserved by Alcoveart.ie or their respective owners.  You may store, print and display the content supplied solely for your own personal use.  You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content, nor may you use any such content in connection with any business or commercial purposes.

Linking to Alcoveart.ie

You may link to our website on the provision that you do so in a way that is fair and legal, and does not damage our reputation or take advantage of it.  Links must not be used in any way that indicates or suggests any form of association, approval or endorsement on our part where none exists.  You must only link from any website that is owned or operated by you, or you have authority to act on that website's behalf.  We reserve the right to withdraw linking permissions without notice, and may ask you to remove any links to our website at our discretion.

External Links

We may link from our website, blogs or social media to other external websites or sources.  This may be for attribution, for further information or for entertainment purposes.  Linking does not indicate any form of recommendation, association, approval or endorsement on our part or the external website's part unless we specifically state.  Alcove Art is not responsible for the running or content of these external websites, and thus you enter external sites at your own risk.

Comments, Mentions, Feedback, Reviews and other User Content

You give permission for us to use comments, mentions, feedback, reviews and other content, including images, which may mention or show our brand, products, premises or staff, whether provided directly to us or via social media, review sites, our website, other websites or print medium, with no obligation for us to attribute or compensate.  We also reserve the right to remove content at our discretion, or where that content is hosted on third party sites, ask for the content to be removed.

Other Terms

All the actions taken by the user of the website are the responsibility of the individual.  It is the users' responsibility to ensure they act within the laws of Ireland and the users' respective territories.

From the time of dispatch of the goods any loss or damage to the goods shall be at your own risk.

You will own the goods once we have received your payment in full.  We do not offer any credit facilities.  We will issue you with an invoice once we have dispatched the goods to you.  Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions.
